China requiring people to visit their aged parents

BEIJING (AP) ? Visit your parents. That's an order.

So says China, whose national legislature on Friday amended its law on the elderly to require that adult children visit their aged parents "often" ? or risk being sued by them.

The amendment does not specify how frequently such visits should occur.

State media say the new clause will allow elderly parents who feel neglected by their children to take them to court.

A rapidly developing China is facing increasing difficulty in caring for its aging population. Three decades of market reforms have accelerated the breakup of the traditional extended family in China, and there are few affordable alternatives, such as retirement or care homes, for the elderly or others unable to live on their own.

Lawmakers, Obama in last chance talks on "fiscal cliff"

WASHINGTON (Reuters) - President Barack Obama and lawmakers are launching a last-chance round of budget talks days before a New Year's deadline to reach a deal or watch the economy go off a "fiscal cliff."

Obama and Vice President Joe Biden will meet congressional leaders from both parties at the White House on Friday at 3 p.m. EST (2000 GMT) to try to revive negotiations to avoid tax hikes and spending cuts - together worth $600 billion - that will begin to take effect on January 1.

Members were divided on the odds of success, with a few expressing hope, some talking as if they had abandoned it and a small but growing number suggesting Congress might try to stretch the deadline into the first two days of January.

In order to be ready to legislate if an agreement takes shape, the Republican-dominated House of Representatives convened a session for Sunday.

And House Majority Leader Eric Cantor advised members to be prepared to meet through January 2, the final day before the swearing-in of the new Congress elected on November 6.

It "doesn't feel like anything that's very constructive is going to happen" as a result of the meeting with Obama, said Tennessee Republican Sen. Bob Corker. "It feels more like optics than anything that's real.

The two political parties remained far apart, particularly over plans to increase taxes on the wealthiest Americans to help close the U.S. budget deficit. But one veteran Republican, Rep. Jeff Flake of Arizona, held out the prospect that if Obama came through with significant spending cuts, Republicans in the House might compromise on taxes.

The coming days are likely to see either intense bargaining over numbers, or political theater as each side attempts to avoid blame if a deal looks unlikely.

"Hopefully, there is still time for an agreement of some kind that saves the taxpayers from a wholly, wholly preventable economic crisis," Mitch McConnell, the top Republican in the Democratic-controlled Senate, said on the Senate floor.

But the rhetoric was still harsh on Thursday after months of wrangling - much of it along ideological lines - over whether to raise taxes and by how much, as well as how to cut back on government spending.

Senate Majority Leader Harry Reid, the top Democrat in Congress, accused Republican House Speaker John Boehner of running a "dictatorship" by refusing to allow bills he did not like onto the floor of the chamber.

Reid urged Republicans in the House to prevent the worst of the fiscal shock by getting behind a Senate bill to extend existing tax cuts for all except those households earning more than $250,000 a year.

Both Reid and Boehner, as well as McConnell and House Minority Leader Nancy Pelosi, are to meet Obama on Friday.

MARKETS EASE

U.S. stocks sharply cut losses after news of the House reconvening as investors clung to hopes of an 11th-hour deal. Even a partial agreement on taxes that would leave tougher issues like entitlement reform and the debt ceiling until later could be enough to keep markets calm.

"I'm not convinced it will result in a deal, but you could get enough concessions by both parties to at least avoid the immediacy of going over the cliff," said Randy Bateman, chief investment officer of Huntington Asset Management, in Columbus, Ohio.

Obama arrived back at the White House on Thursday from a brief vacation in Hawaii that he cut short to restart stalled negotiations with Congress.

He is likely to meet the toughest resistance from Republicans in the House, where a group of several dozen fiscal conservatives have opposed any tax hikes at all.

But Flake of Arizona said his fellow Republicans in the House and Senate are resigned to seeing some sort of increase in top income tax rates. But they will push back if Obama does not offer spending cuts.

"There will be resistance from a lot of House conservatives to a deal that does that," Flake said.

Strictly speaking, the fiscal cliff measures begin on January 1 when tax rates go up but the House might stay in session until the following day if an agreement is being worked out.

"This January 1 deadline is a little artificial. We can do everything retroactively. We have to get it right, not get it quickly," said Republican Representative Andy Harris.

Another component of the "fiscal cliff" - $109 billion in automatic spending cuts to military and domestic programs - is set to kick in on January 2.

The House and Senate passed bills months ago reflecting their own sharply divergent positions on the expiring low tax rates, which went into effect during the administration of former Republican President George W. Bush.

Democrats want to allow the tax cuts to expire on the wealthiest Americans and leave them in place for everyone else. Republicans want to extend the tax cuts for everyone.

In another sign that Americans are increasingly worrying about their finances as Washington fails to address the budget crisis, consumer confidence fell to a four-month low in December.

Americans blame Republicans in Congress more than congressional Democrats or Obama for the fiscal crisis, a Reuters/Ipsos poll showed.

When asked who they held more responsible for the "fiscal cliff" situation, 27 percent blamed Republicans in Congress, 16 percent blamed Obama and 6 percent pointed to Democrats in Congress. The largest percentage - 31 percent - blamed "all of the above."

Putin signs law banning American adoptions - World News

Russian President Vladimir Putin signed into law a ban on Americans adopting children from Russia. Many Americans, and many Russians, see the ban as a political maneuver that comes at the expense of children. Channel Four's Jane Deith reports.

By NBC News staff and wire reports

President Vladimir Putin signed a law on Friday that bans Americans from adopting Russian children and imposes other measures in retaliation for new U.S. legislation meant to punish Russian human rights abusers.

The law, which has ignited outrage among Russian liberals and children's rights advocates, enters into force on Jan. 1 and is likely to strain U.S.-Russia relations.

As well as banning U.S. adoptions, it will also outlaw some non-governmental organizations that receive U.S. funding and impose a visa ban and asset freeze on Americans accused of violating the rights of Russians abroad.

The law could block dozens of Russian children expected to be adopted by American families from leaving the country and cut off one of the main international routes for Russian children to leave orphanages that are often dismal. Russia is the single biggest source of adopted children in the United States, with more than 60,000 Russian children being taken in by Americans over the past two decades.

The bill is retaliation for an American law that calls for sanctions against Russians deemed to be human rights violators and part of an increasingly confrontational stance by the Kremlin against the West.

Related: Americans may lose right to adopt Russian children

Putin said U.S. authorities routinely let Americans suspected of violence toward Russian adoptees go unpunished ? a clear reference to Dima Yakovlev, a Russian toddler for whom the bill is named. The child was adopted by Americans and then died in 2008 after his father left him in a car in broiling heat for hours. The father was found not guilty of involuntary manslaughter.

Children's rights ombudsman Pavel Astakhov on Wednesday said that 46 children who were about to be adopted in the United States would remain in Russia if the bill came into effect. On Thursday, he petitioned the president to extend the ban to other countries.

John and Renee Thomas with their son, Jack, 7, who was adopted from Russia at the age of 3. Jack is hoping for his brother, Nikoly, now in a Russian orphanage, to join him in the United States.

Would-be adoptive parents in the United States are left hanging by Putin's signing of the bill, which was passed by Russian lawmakers last week.

Among them are John and Renee Thomas of Minnetonka, Minn., Kari Huus of NBC News reported.?The Thomases have already adopted Jack, 7, from Russia. When they found out he had a little brother, they began the process to try to adopt him, too. The wait has stretched to four years, and now the adoption may be in danger.?

"When Jack is asked about his family, he talks about his brother," John Thomas said. "He always asks, 'When is he coming home?' We just tell him we?re waiting for the call."

More: Adoption of little brother caught in US-Russia spat

UNICEF estimates that there are about 740,000 children without parental custody in Russia, while only 18,000 Russians are now waiting to adopt a child.

Russian President Vladamir Putin has said he'll sign a proposed law that would halt adoptions of Russian children to Americans. NBC's Duncan Golestani reports.

The U.S. State Department on Thursday repeated its opposition to the Russian measure.

"The welfare of children is simply too important to tie to the political aspects of our relationship," State Department spokesman Patrick Ventrell said. "Additionally, we are deeply troubled by the provisions in the bill that would restrict the ability of Russian civil society organizations to work with American partners." ?

Critics of the bill left dozens of stuffed toys and candles outside the parliament's lower and upper houses to express solidarity with Russian orphans.?

An online petition urging the Kremlin to scrap the bill garnered more than 100,000 Russian signatures.?

Jury Finds Marvell Owes $1.17 Billion in Patent Case - Ask Any Law ...

By DON CLARK

A federal jury in Pittsburgh found Wednesday that chip-maker Marvell Technology Group Ltd.

should pay nearly $1.17 billion for infringing patents held by Carnegie Mellon University.

The award ranks as the third largest ever in a patent case, according to Lex Machina Inc., a firm that provides data and analytic services used in intellectual-property litigation.

The verdict comes amid a surge in patent litigation around the world, much of it conducted by rivals in the smartphone industry or by companies that buy up and enforce patents.

Marvell, by contrast, was accused by a university of infringing patents related to disk drives used in personal computers, server systems and other products. The damages set by the jury would top the award of about $1 billion issued in August against Samsung Electronics Co.

in a closely watched case against Apple Inc.

In response, Marvell?s shares plunged 10% to $7.40 at 4 p.m. on the Nasdaq Stock Market

. The company ended Wednesday with a market value of nearly $4 billion. Marvell, which is known for chips used in data-storage applications, had $2 billion in cash and investments as of Oct. 27.

A spokesman for Marvell said the Santa Clara, Calif., company was disappointed by the verdict but hopeful the judge would reverse the finding based on post-trial motions. If unsuccessful in that effort, Marvell will appeal, he said.

K&L Gates LLP, a law firm representing Carnegie Mellon, said the jury agreed with its allegations that Marvell sold billions of chips incorporating the patented technology without a license to do so.

The jury?s finding of what amounts to willful infringement provides a legal foundation for the judge to increase the damages by as much as three times the amount awarded by the jury, the firm said.

Large jury verdicts in patent cases are often sharply reduced following appeals. On the other hand, interest typically accrues during that process.

?By any measure this is a substantial damages award, which could become even larger,? said Alan Fisch, an attorney at Fisch Hoffman Sigler LLP in Washington, D.C., who isn?t involved in the case. He predicted the appeal process could last 18 months before a final resolution is reached in the case.

Carnegie Mellon sued Marvell in 2009 in the federal court for the Western District of Pennsylvania, alleging the company had infringed patents covering technology associated with ?noise predictive detection,? which is used to increase accuracy in retrieving data from drives.

The inventions were credited to Jos? Moura, a professor at the university, and a graduate student, Alek Kavcic, who is now a professor at the University of Hawaii.

Marvell Calif., argued in court that it didn?t infringe the patents. It alleged that the patents at issue were improperly obtained by withholding information about prior inventions from the U.S. Patent and Trademark Office.

The jury disagreed, finding Wednesday that Marvell products infringed all the patent claims asserted by Carnegie Mellon in the case, according to a verdict form filed with the court.

The jury assessed damages totaling $1.17 billion, upheld the validity of the patents, and ruled that Marvell knew or should have known that its actions would infringe the patents.

The verdict followed a four-week trial before U.S. District Judge Nora Barry Fischer. Marvell last week asked her to declare a mistrial on grounds that lawyers representing Carnegie Mellon made a series of inflammatory statements in closing arguments that ?misrepresented the record and violated at least two of the court?s orders in this case,? according to a brief filed by the company?s lawyers.

Judge Fischer denied the motion for the mistrial ?without prejudice,? indicating that the issues raised by the company could be reviewed later. Other potential issues for Marvell to raise following the verdict include delays by Carnegie Mellon in filing its suit after it learned of the alleged infringement.

ZTE Grand S should be just 69mm inches thick, wield a 13MP camera

ZTE has been more than willing to spill the beans about the Grand S ahead of CES, and it's not stopping with the mention that the phone exists. The Chinese phone maker has confirmed that its 5-inch smartphone measures just 6.9mm (0.27in) thick -- that's a sight slimmer than the Droid DNA and Nubia Z5. There's also mention of a 13-megapixel camera that explains a slightly visible rear hump. While we don't yet have confirmation of the rumored quad-core Snapdragon S4 Pro and 2GB of RAM, ZTE has left clues that the flagship could undercut typical pricing with a ¥2,799 ($449) off-contract cost in China. We may only know the full details in Las Vegas, but there's every indication that the Grand S hardware could justify a boast or two.

Afghan bomber attacks near major US base near Pakistan border, killing 4

NATO forces and foreign civilians have been increasingly attacked by rogue Afghan military and police, eroding trust between the allies.

Police Gen. Abdul Qayum Baqizai said a local guard who questioned the vehicle driver at the gate of Camp Chapman was killed along with two civilians and the assailant. The camp is located adjacent to the airport of the capital of Khost Province, which borders Pakistan.

Chapman and nearby Camp Salerno had been frequently targeted by militants in the past, but violent incidents have decreased considerably in recent months.

Taliban spokesman Zabihullah Mujahid said in an e-mail that the bomber targeted Afghan police manning the gate and Afghans working for the Americans entering the base. He claimed high casualties were inflicted.

NATO operates with more than 100,000 troops in the country, including some 66,000 American forces. It is handing most combat operations over to the Afghans in preparation for a pullout from?Afghanistan?in 2014. Militant groups, including the Taliban, rarely face NATO troops head-on and rely mainly on roadside bombs and suicide attacks.

NATO forces and foreign civilians have also been increasingly attacked by rogue Afghan military and police, eroding trust between the allies.

On Tuesday, the Interior Ministry said a policewoman who killed an American contractor in Kabul a day earlier was a native Iranian who came to?Afghanistan?and displayed "unstable behavior" but had no known links to militants.

The policewoman, identified as Sgt. Nargas, shot Joseph Griffin, of Mansfield, Georgia, on Monday, in the first such shooting by a woman in the spate of insider attacks. Nargas walked into a heavily-guarded compound in the heart of Kabul, confronted Griffin and shot him once with her pistol.

The US-based security firm DynCorp International said on its website that Griffin was a US military veteran who earlier worked with law enforcement agencies in the United States. In Kabul, he was under contract to the NATO military command to advise the Afghan police force.

The ministry spokesman, Sediq Sediqi, told a news conference that Nargas, who uses one name like many in the country, was born in Tehran, where she married an Afghan. She moved to the country 10 years ago, after her husband obtained fake documents enabling her to live and work there.

A mother of four in her early 30s, she joined the police five years ago, held various positions and had a clean record, he said. Sediqi produced an Iranian passport that he said was found at her home.

No militant group has claimed responsibility for the killing.

The chief investigator of the case, Police Gen. Mohammad Zahir, said that during interrogation, the policewoman said she had plans to kill either the Kabul governor, city police chief or Zahir himself, but when she realized that penetrating the last security cordons to reach them would be too difficult, she saw "a foreigner" and turned her weapon on him.

There have been 60 insider attacks this year against foreign military and civilian personnel, compared to 21 in 2011. This surge presents another looming security issue as NATO prepares to pull out almost all of its forces by 2014, putting the war against the Taliban and other militant groups largely in the hands of the Afghans.

More than 50 Afghan members of the government's security forces also have died this year in attacks by their own colleagues. The Taliban claims such incidents reflect a growing popular opposition to the foreign military presence and the Kabul government.

Christmas provides Connecticut town a break from mourning

NEWTOWN, Connecticut (Reuters) - Christmas has helped some people in the grieving Connecticut town of Newtown cope a little better with the shooting tragedy that killed 20 schoolchildren, while others have yet to feel the holiday joy.

Smiles returned for those taking a respite from the mourning now that funerals for the victims have concluded. For the crestfallen, the holiday spirit was absent in a town that just buried its children.

"We're getting through this with our faith and our prayer. People are smiling a little more now," said John Barry, owner of an information technology staffing company. "The week was so horrible. Now it's time to celebrate Christmas."

This largely Christian town was shaken on the morning of December 14, when a 20-year-old gunman armed with a military-style assault rifle shot dead 20 children aged 6 and 7 and six adults at Sandy Hook Elementary School. It was the second-deadliest school shooting in U.S. history.

Little is known about the shooter, Adam Lanza, who also killed his mother before the rampage and later himself to create a death toll of 28 in a tragedy that has revitalized the debate over U.S. gun control laws.

The sadness has moved some to act. Makeshift monuments to the dead have popped up all over town, funds have been raised, and many visitors have made a pilgrimage to Newtown, offering support.

"It doesn't feel like Christmas. It's too sad to feel like Christmas," said Joanne Brunetti of Newtown, who was staffing a 24-hour candlelight vigil in the center of town early Christmas morning. "I got my shopping done a lot later than usual. I just felt like my heart wasn't in it."

At another monument across town, Tim O'Leary of nearby Danbury, Connecticut, said reading the memorials to the victims only helped "a little."

"It (Christmas) shouldn't even be happening," O'Leary said. "Life has changed as we know it."

MISSING ANGEL

The mood was more uplifting at Christmas Eve Mass on Monday night at Saint Rose of Lima Roman Catholic Church, which held its biggest service at the high school auditorium.

Parishioners Dan and Michelle McAloon of Newtown decided to go Christmas caroling this year for the first time, gathering other families and children to roam a neighborhood where the families of three victims live.

"We were just spreading some cheer, trying to make the situation a little better," Michelle McAloon said.

"They all smiled, and they all cried a little," she said of the victims' families.

"Everybody said we are doing it again next year," Dan McAloon said of the carolers. "It's going to become a tradition."

Nine families from the parish lost someone in the shooting, and at least four of those families came to the big Christmas Eve Mass, Monsignor Robert Weiss said.

"There is reason to celebrate," Weiss said after the service. "Hopefully when people start to see their extended families, or people from outside of Newtown, or even go out of town, they will be able to. You can't get away from it in this town," he said.

Christmas Eve Mass featured a pageant that told the Christian story of Jesus' birth. One of the more poignant moments came when people applauded a group of two dozen little girls dressed as angels. They all knew shooting victim Olivia Engel, 6, was supposed to be among them.

"I highly recommend that before you rip open those gifts, say a prayer for those children," Weiss told parishioners. "Then give your own children a hug."

Egypt's contentious Islamist constitution becomes law

CAIRO (Reuters) - Egyptian President Mohamed Mursi signed into law a new constitution shaped by his Islamist allies, a bitterly contested document which he insists will help end political turmoil and allow him to focus on fixing the economy.

Anxiety about a deepening political and economic crisis has gripped Egypt in past weeks, with many people rushing to buy dollars and withdraw their savings from banks. The Egyptian pound tumbled on Wednesday to its weakest level against the U.S. currency in almost eight years.

The new constitution, which the liberal opposition says betrays Egypt's 2011 revolution by dangerously mixing religion and politics, has polarized the Arab world's most populous nation and prompted occasionally violent protest on the streets.

The presidency said on Wednesday that Mursi had formally approved the constitution the previous evening, shortly after results showed that Egyptians had backed it in a referendum.

The text won about 64 percent of the vote, paving the way for a new parliamentary election in about two months.

The charter states that the principles of sharia, Islamic law, are the main source of legislation and that Islamic authorities will be consulted on sharia - a source of concern to the Christian minority and others.

The referendum result marked yet another electoral victory for the Islamists since veteran autocrat Hosni Mubarak was toppled in 2011, following parliamentary elections last year and the presidential vote that brought Mursi to power this year.

Mursi's government, which has accused opponents of damaging the economy by prolonging political upheaval, now faces the tough task of building a broad consensus as it prepares to impose austerity measures.

CRISIS ATMOSPHERE

The atmosphere of crisis deepened this week after the Standard & Poor's agency downgraded Egypt's long-term credit rating and warned of a possible further cut. The government has imposed currency restrictions to reduce capital flight.

The pound traded as low as 6.1775 against the dollar on Wednesday, close to its all-time low of 6.26 hit on October 14, 2004, on concerns that the government might devalue or tighten restrictions on currency movements.

"All customers are rushing to buy dollars after the downgrading," said a dealer at a Cairo-based bank. "We'll have to wait to see how the market will operate with the U.S. dollar, because as you know there is a rush at the moment."

Keen to be seen as decisive, the government is now in talks with business figures, trade unions and other groups to highlight the need for tax increases to resolve the crisis.

Mursi has committed to such austerity measures to receive a $4.8 billion loan from the International Monetary Fund.

However, Al-Mal newspaper quoted Planning Minister Ashraf al-Araby as saying the government would not implement the tax increases until it had completed the dialogue with different parts of society.

In Cairo's bustling centre, people openly expressed their frustration with economic instability as they went about their daily business.

"The country's going to the pits. Everything is a mess," Hamdy Hussein, a 61-year-old building janitor, said angrily. "It's worse than ever. Mubarak was better than now. People were living and there was security."

Ashraf Mohamed Kamal, 30, added: "The economic situation will be a mess in the next few years. It already is. People will get hungrier. People are now begging more."

TURMOIL CONTINUES

Mursi, catapulted into power by his Islamist allies this year, believes adopting the constitution quickly and holding the vote for a permanent new parliament will help to end the long period of turmoil and uncertainty that has wrecked the economy.

Mursi's government argues the constitution offers enough protection to all groups, and that many Egyptians are fed up with street protests that have prevented a return to normality and distracted the government from tackling the economy.

The charter gives Egypt's upper house of parliament, which is dominated by Islamists, full legislative powers until the vote for a new lower house is held.

While stressing the importance of political stability to heal the economy, Mursi's government has tried to play down the economic problems and appealed for unity despite the hardship.

"The government calls on the people not to worry about the country's economy," Parliamentary Affairs Minister Mohamed Mahsoub told the upper house in a speech. "We are not facing an economic problem but a political one and it is affecting the economic situation. We therefore urge all groups, opponents and brothers, to achieve wide reconciliation and consensus."

Mursi is due to address the upper house on Saturday in a speech likely to be dominated by economic policy.

Sharpening people's concerns, the authorities imposed currency controls on Tuesday to prevent capital flight. Leaving or entering Egypt with more than $10,000 in cash is now banned.

Adding to the government's long list of worries, Communications Minister Hany Mahmoud has resigned citing his "inability to adapt to the government's working culture".

The opposition has condemned the new basic law as too Islamist, saying it could allow clerics to intervene in the lawmaking process and leave minority groups without proper legal protection. It said this month's vote was marred by major violations.

Nevertheless, major opposition groups have not called for new protests, suggesting that weeks of civil unrest over the constitution may be subsiding now that it has passed.

The United States, which provides $1.3 billion a year in military aid plus other support to Egypt and sees it as a pillar of security in the Middle East, called on Egyptian politicians to bridge divisions and on all sides to reject violence.

Is Cheap Furniture Worth Buying?

Is Cheap Furniture Worth Buying? Dear Lifehacker,
I'm moving into a new apartment, and I don't really have a lot of furniture to my name. Should I just head out to Ikea, buy everything I need, and save some cash? Or should I hit the big furniture showroom and deal with making appointments for something that'll actually last? Is there any way I can get something long-term without killing my bank account?

Sincerely,
Amateur Interior Designer

Dear Amateur Interior Designer,
We understand where you're coming from, and I think we've all been there: You've just moved into a new apartment. Maybe it's your first, maybe it's a college dorm, or maybe you just don't have a lot of stuff. Most of us probably have a combination of inherited furniture we got from friends and family, but before you hit the showroom or load up at Ikea, here are a few things to consider to net the best bang for your buck.

Before Anything Else: Plan Your Space

Is Cheap Furniture Worth Buying? Before you run out and spend your money, take time to plan out the space so you know what you can fit, what colors and designs you like, and what furniture you really need. It may seem like common sense, but it's critically important to do first. You may think you have room for a couch and a couple easy chairs, but the last thing you want is to start shopping and have no idea how large those items should be, or worst, buy something you have to shoehorn into your space. Photo by Francis Storr.

One tip that's worked for me in the past is to template my furnitures with pieces of paper if I already know what I want to put into a room. Measure your space so you know what you have to work with. Even better, draw it all out on some graph paper and take that shopping with you so you can compare your measurements against the size of the furniture you want to buy. For the tech-inclined, webapps like Google Sketchup, Design Your Dorm, IKEA Planner, Floorplanner, and the Make Room Planner can help. Once you have your measurements, you should have an idea of what you want to fit into your space, and your budget will dictate how much of your dream apartment you'll be able to buy.

Make a Shopping Plan Based on How Long You Plan to Live There

Is Cheap Furniture Worth Buying? The next thing you need to think about is how long you'll be living in the space to which you've just moved. We've talked about how if you can't commit five years to a career path, then it's not a path. Consider the same for your apartment. Regardless of your budget or your eye for quality, keep in mind how long you plan to live there. Photo by Lenore Edman.

If you know you're moving in a year?especially if you're not sure where you're moving?there's no reason to blow your budget on expensive pieces sized for the place you just moved into. If you know you'll be there for a few years?maybe between three and five?you'll want some resilient, quality furniture, but obviously not everything. If you're moving into a house you plan to live in for ten years or more, you should be comfortable buying furniture that you expect to last the long haul, and that hopefully you won't have to replace every year or so. Similarly, even if you move frequently but know you'll stay in the same area, make that your multi-year plan and buy some quality pieces you know you'll always use, no matter where you go.

Finally, when we say making a furniture shopping plan, we mean that. Don't just run out and buy all the furniture you'll need at one time. It can be tempting to go to Ikea and load up your car with everything you could possibly want, but choose essentials first and bring them home before anything else. Once the essentials, like a bed, couch, desk, and things you know you must have are in your space, then you can decide whether you need anything more. Remember, just because you have room for it doesn't mean you need it. Leave that space free for things you may want in the future, or?heaven forbid?own less stuff.

Spend Your Money Where Your Time Goes

Is Cheap Furniture Worth Buying? The "buy with the amount of time you plan to live in your home in mind" rule is great, but there's one area where it falls down: Places you spend most of your time. This is called The Comfort Principle. Furniture that you use most often and are essential to your life, comfort, or quality of life are the ones that deserve the most room in your budget. Photo by tifonimages (Shutterstock).

It's easy to go out and spend a lot of money on a shiny new TV as soon as you move into a new apartment, but if you only watch TV once a week or so, your money could be better spent elsewhere. For example, most people spend between six and eight hours in bed every day sleeping. If you spend more on your entertainment center, which you may use for three hours a day at most, than you do on your bed, you should adjust your priorities. If you work from home, your desk, your office chair, and workspace setup deserves a good slice of your budget because you use that equipment most often. If you enjoy cooking, make sure you put some money into making sure your kitchen is set up to foster your love of cooking.

Ideally, the biggest parts of your furniture budget, especially if you're sticking around your new apartment for a while, should go to your bed and bed frame, your desk chair and workspace (if you work from home at all), your couch, and those other parts of your home that you use and enjoy most frequently. Don't be tempted to spend a ton of cash on a chair you never sit in, or a set of end tables that are gorgeous but are still just end tables.

Buy Throwaway or Functional Items On the Cheap

Is Cheap Furniture Worth Buying? Now that you know where you should spend your money freely, let's talk about the places you should save your hard-earned cash. Items that are purely functional or not really visible are great places to save some cash. A set of drawers hidden in a closet, or a nightstand that does nothing but hold your phone and an alarm clock for example. Similarly, if your furniture plan says that you'll be moving in a few years and you need something in the interim that's specific to the space you live in now, that's the type of furniture you should buy affordably. Photo by Karl Baron.

Those are the things you can swing over to a discount furniture store for and pick up on sale. Whether it's your favorite designer pressboard assemble-it-yourself store or your local big-box department store, this is where you can safely save some money.

Avoid Showrooms Unless There's Something You Must Have

Is Cheap Furniture Worth Buying? When it comes to big showrooms, the kind where you eventually have to custom order your couch or dining room set from a salesperson or make an appointment just to visit, we'd suggest avoiding them altogether. There are some exceptions, largely for discount showrooms and wholesalers where you can shop freely and only place an order if you need to or they don't have the specific model you want in-house. However, the furniture showroom experience is usually built from top to bottom to get you to spend as much money as possible on products that aren't worth that money. Think "used car lot," just with dining room sets and custom-order couches. Photo by T.W. van Urk (Shutterstock).

Unless there's something very specific you want and have to have, or your budget allows for it, don't bother with them. You can do your research online to find the perfect piece of furniture first, and then head into a showroom if you must. Walking into one blind however, armed only with your budget and your measurements, will inevitably result in you sitting across from a salesperson who wants to upsell you on "nanotech stain resistant treatments" for the couch that you're already not getting for the sale price.

Instead, if you know you really want a dark wood dining room table that seats six, shop online at those popular stores' websites and see if you can order there. Compare pricing between wholesalers and showroom stores. See if you can order direct from manufacturers. Your money will go farther, and your wallet will thank you.

Shop for Used Bargains, but Exercise Caution

Is Cheap Furniture Worth Buying? Of course, if you're shopping for quality, old, or hardwood pieces but don't have a lot of money to spend, you can do better than discount furniture stores or expensive showrooms altogether. Consider buying used, from auctions, estate sales, thrift stores, or even on the web through Craigslist (just don't get screwed!) or Freecycle. There are definitely bargains to be had, and especially with estate sales and thrift stores you can frequently find beautiful, well cared-for items at decent prices. Photo by The Living Room.

When it comes to buying used furniture however, make sure that you examine each piece carefully for wear and tear, damage, and any signs of insects or pests. Sadly, bedbugs and other pests can make their homes in the cracks and nooks in even old wooden furniture, and hitch a ride home with you if they're coming from a house or apartment where they used to thrive. Make sure you carefully evaluate the surroundings and the seller before you take anything used home with you. For some people, even a great bargain isn't worth that risk, so you'll have to make that call.

Ultimately, cheap furniture can be worth buying, as long as you know why you're buying it. If it fits, it's functional and not aesthetic, and you understand you're trading durability for cash, then it's a good idea. Finding a used diamond in the rough is a great way to score quality furniture on a budget. The only place we wholeheartedly say used furniture is not worth it is if you're trying to save money on something you use every day. Furniture that's essential to your health or comfort is worth your money.

Armed with a firm budget and a plan for your space, you can't go wrong. Shop around, buy your essentials first, and remember, cheap doesn't mean low-quality. Just keep an eye out for a great deal and you'll be fine. Good luck!

Sincerely,
Lifehacker

Sprint salesman refuses to sell iPhone to customer, says his ?fingers are too fat? to use it

On Sunday morning, Wayne LaPierre, CEO of the National Rifle Association, told the world that armed guards stopped school shootings in Israel. Israel begs to differ. "Israel had a whole lot of school shootings until they did one thing," LaPierre said sitting calmly on Meet the Press. "They said, 'We're going to stop it,' and they put armed security in every school, and they have not had a problem since then."

Firefighters ambushed by gunman while responding to house fire

Residence near shooting and fire in Webster evacuated. (Max Schulte/Rochester Democrat&Chronicle via Twitter)

A gunman set a trap and shot and killed two firefighters responding to an early morning blaze in Webster, N.Y., police officials said. Two other firefighters were in serious condition.

"It does appear that it was a trap that was set for first responders, but the cause or reasons we don't have at this time," said Webster Police Chief Gerald Pickering as he described? the scene where shots were fired at West Webster firefighters when they arrived at 5:35 a.m. to battle the blaze along Lake Road. Webster is about 10 miles east of Rochester.

The apparent gunman was found dead at the scene, but it?s unclear if he was killed by? a self-inflicted gunshot or if it was from a weapon from police officers who were chasing him.

The victims were Mike Chiapperini, also a lieutenant and public information officer with the local police department, and Tomasz Kaczowka, Pickering said.

Chiapperini was described by Pickering as a lifelong firefighter who started with the department's explorer program and had about 20 years of experience. Kaczowka was a younger firefighter and was also a 911 dispatcher, he said.

West Webster firefighters Joseph Hofsetter and Theodore Scardino were seriously injured and are at Strong Memorial Hospital with gunshot wounds, a hospital spokeswoman said.? Scardino? has? injuries to his chest and lungs. Hofsetter was injured in the pelvis, the spokeswoman said at a media briefing.

Pickering said that one of the firefighters who survived made his way across a bridge to get to safety. The other three did not make it across, Pickering said. Police arrived and rescued the other three firefighters, but two were fatally shot, Pickering said.

"These are volunteers who get up in the middle of the night to fight fires, they don't expect to be shot and killed," a tearful Pickering said at the press conference.

The morning scene was described as chaotic as police and firefighters dealt with an immense blaze as well as gunshots,? local news station WHAM-TV? reports.

?I?m not aware of anything like this happening in Webster, obviously not a firefighter being fired upon,? Webster Fire Marshal Rob Boutillier told the Democrat & Chronicle.? Pickering described Webster as resort lakeside community that is quiet and usually peaceful.

There at least four houses that have been damaged by the fire along Lake Road, WHAM-TV reported. Firefighters had to leave the scene and stop battling the blazes while police secured the scene. They continue to battle the blaze.

Retro Game Network | The New Retro Gaming Community ...

USB Power

Admit it, you emulate. You emulate all the time, and you love it.

It?s okay, we?ve all done it. Without emulation, the classic gaming scene as we know it wouldn?t exist. If not for emulation, we probably wouldn?t have discovered all of the hidden gems of generations past. There?s no way we could afford most of these games, and imagine the years a single game could potentially take to track down. Better hope it?s good. My first experience playing earthbound was back in 1998 on a copy of ZSNES, and most of the most treasured games in my collection were first revealed to me by ArchNahco and TortillaGodzilla.

The biggest issue I?ve always had with emulation, however, is the controls. I spent weeks in the late 90?s trying to play Contra III on my Gateway?s keyboard, warping my hand in a way that will forever alter my ability to play the recorder. Indeed, for a long time it was difficult to accurately control your games via emulation, and even if you found a game pad that you could hook up to your computer you?d still have to find drivers and pray that your emulator of choice supported it. Thankfully, with the advent of USB, that?s all changed.

The USB port is a wonderful thing, and has completely revolutionized emulation. Dozens of computer companies make generic gamepads that will suit the needs of most emulated games, and there are a good few options if you want to get the most accurate feel. Sites like Retrozone provide some excellent options, you can buy adaptors to hook up the same controllers you?ve used all your life, or you can buy pre-modded controllers that you can plug right in and start using within seconds. All of these options are by all means good. I?ve used them all and I?ve been happy with the experience. That being said, I think I?ve found my controller for the foreseeable emulated future.

Sega released a USB pad modeled after the Saturn?s controller a few years ago, and they sold like hotcakes. The Saturn controller is considered by many to be one of the best controllers of all time, and I?m inclined to agree. Naturally, people bought up these controllers up, and now they go for the price of most of the Saturn?s best games themselves, bummer.

Thank goodness for China.

A quick ebay query of ?Sega Saturn USB? will provide wonderfully inexpensive knockoffs by a company called G-TRON. Now, in case you don?t already know G-TRON, they?re a company who has been making these Saturn USB controllers for at least as long as I?ve searched for them on ebay. While of dubious origin, these controllers are ridiculously cheap (They can be found for as little as $6.99 with free shipping) and appear to be made from a mold almost identical to the actual Saturn controllers. The quality is around 80% of what a real controller feels like, and the cord is long enough for use with a computer. These pads are nicely made facsimiles of their ancestors in true six button glory, which leads to their most unexpected advantage.

As you may or may not know, the Saturn has six face buttons and two shoulder buttons. This makes the Saturn pad excellent for fighting and arcade games, as the six button setup is pretty common. However, most consoles before the Saturn had less than six buttons, leaving you with several unused buttons that do nothing unless you map them. Most emulators now have dozens of extras built into them ? video recorders, slow motion, save states etc. Usually these would be nice little features that you could use if you remembered the keyboard shortcut, but most often these were left unused, lost in the shuffle of quasi-legal gaming. With a controller though, you can map these features to buttons on the pad itself. As the SNES only has four face buttons, you can map two of them to take screenshots and start recording footage respectively. This is an incredibly useful tool, especially for budding game reviewers. While a purist will capture footage for the original hardware, you can easily make do with footage quelled from your emulator of choice as having a button mapped to the pad itself makes the recording process virtually seamless. The buttons can be mapped to whatever you?d like, so I suggest tooling around in the preferences of your emulator of choice to see how you can best make use of it.

So while emulation may never feel the same as playing classic games on the consoles they were made for, with a USB Saturn pad will make things one step closer to feeling like the real thing. The build quality won?t be perfect, and the shipping may take a while, but for $6.99, it?s well worth the meager investment to use all the built in features of your favorite emulator while still protecting your future ability to play the recorder.

Dealing with Threats to Your Marriage: Lessons from Iowa ...

Last week, the Iowa Supreme Court decided that a dentist, Dr. James Knight, did not violate employment discrimination law when he fired his assistant, Melissa Nelson, for being ?irresistibly attractive? and posing a threat to his marriage to his wife, Jeanne.?(Read the court's opinion here.) As I discussed at the Good Men Project, while Dr. Knight?s actions are questionable from an ethical point of view?and there is clear evidence of sexual harassment, although Ms. Nelson did not allege this?it is difficult to prove gender-based discrimination when all of his other assistants are women and Ms. Nelson was replaced by a woman.

It was, rather, his particular relationship with Ms. Nelson that became a problem?not to Nelson, but to Dr. Knight?s wife, Jeanne:

Jeanne Knight insisted that her husband terminate Nelson because ?she was a big threat to our marriage.? According to her affidavit and her deposition testimony, she had several complaints about Nelson. These included Nelson?s texting with Dr. Knight, Nelson?s clothing, Nelson?s alleged flirting with Dr. Knight, Nelson?s alleged coldness at work toward her (Ms. Knight), and Nelson?s ongoing criticism of another dental assistant. She added that ?[Nelson] liked to hang around after work when it would be just her and [Dr. Knight] there. I thought it was strange that after being at work all day and away from her kids and husband that she would not be anxious to get home like the other [women] in the office.? (opinion, p. 4)

This is the aspect of the case I want to discuss here: marital jealousy and how (not) to deal with it.

Of course, it?s natural to be jealous of your partner?s coworker, especially if she (or he) is attractive and your spouse is clearly drawn to her (or him). (Frequent texts and late nights together don?t help either.) This is further complicated, in the Iowa case, by the fact that the wife also worked in her husband?s office and was witness to the interactions between him and his assistant.

It would be easier to be sympathetic to Mrs. Knight if not for how she dealt with this perceived threat to her marriage. Rather than discuss her jealousy with her husband, she?with the help of the senior pastor at the couple?s church?demanded that he fire his assistant. Rather than confronting her husband?s possible infidelity head-on, she simply removed the temptation. Not only is this short-sighted?what happens when someday he finds another assistant ?irresistibly attractive??but places the burden of keeping their marriage together on an innocent third party.

If she was that concerned that her husband would cross a line with his assistant?or that he already had, according to however they defined infidelity in their marriage?it strongly suggests a deeper problem in the relationship. If Mrs. Knight was concerned that her husband would carry on an adulterous relationship with a woman they both worked with?or actually leave his wife for the assistant?then the marriage clearly has some cracks. Even Dr. Knight admitted, when talking with Nelson?s husband after the dismissal, that ?he feared he would try to have an affair with her down the road if he did not fire her? (opinion, p. 6). It would be surprising if both partners in a relationship anticipated adultery?with no underlying?problem in the relationship to begin with.

It might have been better if the couple had regarded this situation as a test for both of them. As Immanuel Kant wrote, strength of will and character ?can be recognized only by the obstacles it can overcome? (Metaphysics of Morals, p. 394); in other words, we never know how strong-willed we are until our resolve is tested. Ms. Nelson, as it were, represented an ?obstacle? to be overcome for both the dentist and his wife: he needed to resist his temptation to cross the line with her, and she needed to trust in her husband and their marriage. A confident and solid couple would have faced this temptation together and avoided it. But when faced with this test, the Knights cheated, and simply had the obstacle removed rather than facing it and testing their strength as individuals and as a couple?and Ms. Nelson was the one who paid the price.

If you feel that another person is a threat to your relationship, don?t take it out on that person?she or he is not the problem. The fact that you have concerns, however, suggests that there may be a problem with your relationship that you and your partner need to discuss. Just don't make the other person bear the burden of your relationship problems?not only is this unfair to the other person, but it ignores and perpetuates the problems between you and your partner.

(You know what else is all too often ignored? Your gums. Don't forget to floss!)

-----

Thanks to my friend Lauren Hale (My Postpartum Voice) for the suggestion to look at the case from this angle. (She is not responsible for the lame dentist joke at the end.)

Five Best Photo Filter Apps

Five Best Photo Filter Apps Whether photo filter apps are fun ways to share your mobile photos with friends or you use them to add a touch of personality and custom flair to your snapshots, one thing is for sure: iTunes and Google Play are both full of them. Some of them offer heavy editing tools, others have great social aspects to back them up. We asked you which ones you thought were the best for someone looking into trying a new one, and here are the top five based on your nominations.

When we asked you earlier in the week which photo filter apps were the best, some of you pointed out that you hated photo filter apps and would never use them. That's fine?but many more of you weighed in with your app of choice, whether it let you edit your photos on the go, make minor corrections, or just share with your friends. Here are your favorites.

Five Best Photo Filter Apps

Instagram (iOS/Android, Free)

Now that the whole terms of service fiasco is behind us, many of you called out Instagram as being one of the best photo filter apps available, not because of the number of features or the editing tools available for your photos, but because of the massive social network behind it. Attention goes where your friends are, and that's definitely the case for Instagram. The app does have a few editing tools, like the ability to rotate or apply color-correction to your photos before sharing, but Instagram's strength isn't in making your photos look better, it's in letting your personalize them and share them quickly.

Five Best Photo Filter Apps

Snapseed (iOS/Android, Free)

Snapseed, a photo free editor we love on iOS and that recently landed on Android, is the product of Google's recent acquisition of Nik Software, the company that originally built the app. Call it an Instagram competitor if you want, but Snapseed's focus is on making your photos look fantastic and putting high-quality editing tools in your pocket, not necessarily on being social (although you can do that too.) Snapseed comes loaded with photo filters and personalization tools so you can give your shots that sepia, old-timey look, but it goes further than that. You can tweak and edit entire photos, or just sections of your photo that you'd like to clean up, use the Tune Image feature to tweak everything about your shot, or just hit Auto Correct and let the app handle everything.

Five Best Photo Filter Apps

Pixlr-o-matic (iOS/Android, Free)

Available for iOS and Android (and the web!), Pixlr-o-matic does away with the social aspects almost entirely (although you can certainly share your photo creations after you've finished with them.) The app offers hundreds of photo filters, borders, and other tweaks you can apply to your photos as you take them or afterwards, complete with the ability to overlay multiple effects and filters, preview how the final product will look, and make subtle adjustments along the way. All in all, the app offers something like five million permutations of filters and borders, so you actually can create something unique. If you prefer not to fiddle with your photos in real-time, you can always save them, play with them later, then share them with your friends.

Five Best Photo Filter Apps

Camera+ (iOS, $2)

Our pick for the best camera app for iPhone, Camera+ does much much more than just let you customize your photos. The app was?and many will argue still is?vastly superior to Apple's built-in camera app, and includes tools that help you take better, faster photos. On the customization side however, Camera+ does offer several photo borders, custom filters, and other personalization effects you can apply before or after saving your photo to your Camera Roll. As with other apps, you can layer effects and filters on top of one another, edit your photo, rotate it, crop it, and make it just right before you share it with the world. If you're looking for a complete camera app replacement for the iPhone or iPad, Camera+ is a worthwhile download.

Five Best Photo Filter Apps

Camera ZOOM FX (Android, $3)

Our pick for the best camera app for Android, Camera ZOOM FX is another app that's much more than just a tool for personalizing and adding filters to your photos. Camera ZOOM FX is a complete replacement camera app for Android, one that's fast, lightweight, and offers tools to help you take better shots, take burst shots, line up your photos, and then edit them when you're finished. The app even lets you import previously taken photos to tweak and edit them. It packs dozens of after-effects, color filters, borders, distortions, and other after-effects you can add to your shots before saving them and sharing them with your friends. If there aren't enough in the app for you, you can download add-on packs for more options.

Now that you've seen the top five, it's time to put them to a vote.

No honorable mentions this week, since the majority of you cast your nominations for one of the above five. Still, we're betting that there are more than a few great apps that didn't make the nomination round, or just didn't make the cut. Let us know about your favorite and why it's as good or better than these in the discussions below. Don't just tell us you're "surprised it's not on the list," tell us why you think it should have!

Have something to say about one of the contenders? Want to make the case for your personal favorite, even if it wasn't included in the list? Remember, the top five are based on your most popular nominations from the call for contenders thread from earlier in the week. Make your case for your favorite?or alternative?in the discussions below.

The Hive Five is based on reader nominations. As with most Hive Five posts, if your favorite was left out, it's not because we hate it?it's because it didn't get the nominations required in the call for contenders post to make the top five. We understand it's a bit of a popularity contest, but if you have a favorite, we want to hear about it. Have a suggestion for the Hive Five? Send us an email at tips+hivefive@lifehacker.com!

How fiscal cliff talks fell apart behind closed doors

The first family arrived in the president's idyllic home state of Hawaii early today to celebrate the holidays, but President Obama, who along with Michelle will pay tribute Sunday to the late Sen. Daniel Inouye at the National Memorial Cemetery of the Pacific, could be returning home to Washington sooner than he expected.

That's because the President didn't get his Christmas wish: a deal with Congress on the looming fiscal cliff.

Members of Congress streamed out of the Capitol Friday night with no agreement to avert the fiscal cliff -- a massive package of mandatory tax increases and federal spending cuts triggered if no deal is worked out to cut the deficit. Congress is expected to be back in session by Thursday.

It's unclear when President Obama may return from Hawaii. His limited vacation time will not be without updates on continuing talks. Staff members for both sides are expected to exchange emails and phone calls over the next couple of days.

Meanwhile, Speaker of the House John Boehner is home in Ohio. He recorded the weekly GOP address before leaving Washington, stressing the president's role in the failure to reach an agreement on the cliff.

"What the president has offered so far simply won't do anything to solve our spending problem and begin to address our nation's crippling debt," he said in the recorded address, "The House has done its part to avert this entire fiscal cliff. ... The events of the past week make it clearer than ever that these measures reflect the will of the House."

Fiscal Cliff Negotiations Halted for Christmas Watch Video Cliffhanger: Congress Heads Home after 'Plan B' Vote Pulled from House Floor Watch Video Fiscal Cliff: Boehner Doesn't Have Votes for Plan B Watch Video

Senate Minority Leader Mitch McConnell echoed the sentiment while lamenting the failure to reach a compromise.

"I'm stuck here in Washington trying to prevent my fellow Kentuckians having to shell out more money to Uncle Sam next year," he said.

McConnell is also traveling to Hawaii to attend the Inouye service Sunday.

If the White House and Congress cannot reach a deficit-cutting budget agreement by year's end, by law the across-the-board tax hikes and spending cuts -- the so called fiscal cliff -- will go into effect. Many economists say that will likely send the economy into a new recession.

Reports today shed light on how negotiations fell apart behind closed doors. The Wall Street Journal, citing unnamed sources, reported that when Boehner expressed his opposition to tax rate increases, the president allegedly responded, "You are asking me to accept Mitt Romney's tax plan. Why would I do that?"

The icy exchange continued when, in reference to Boehner's offer to secure $800 billion in revenue by limiting deductions, the speaker reportedly implored the president, "What do I get?"

The president's alleged response: "You get nothing. I get that for free."

The account is perhaps the most thorough and hostile released about the series of unsuccessful talks Obama and Boehner have had in an effort to reach an agreement about the cliff.

Unable to agree to a "big deal" on taxes and entitlements, the president is now reportedly hoping to reach a "small deal" with Republicans to avoid the fiscal cliff.

Such a deal would extend unemployment benefits and set the tone for a bigger deal with Republicans down the line.

In his own weekly address, Obama called this smaller deal "an achievable goal ... that can get done in 10 days."

But though there is no definitive way to say one way or the other whether it really is an achievable goal, one thing is for certain: Republican leadership does not agree with the president on this question.

Of reaching an agreement on the fiscal cliff by the deadline, Boehner said, "How we get there, God only knows."

WASHINGTON (AP) ? President Barack Obama has throttled back his ambitions for a sweeping budget bargain with Republicans. Instead, he's calling for a scaled-back measure sufficient to prevent the government from careening off the "fiscal cliff" in January by extending tax cuts for most taxpayers and forestalling a painful set of agency budget cuts.

In a White House appearance Friday, Obama also called on Congress to extend jobless benefits for the long-term unemployed that would otherwise be cut off for 2 million people at the end of the year.

Obama's announcement was a recognition that chances for a larger agreement before year's end have probably collapsed. It also suggested that any chance for a smaller deal may rest in the Senate, particularly after the collapse of a plan by House Speaker John Boehner, R-Ohio, to permit tax rates to rise on million-dollar-plus incomes.

"In the next few days, I've asked leaders of Congress to work towards a package that prevents a tax hike on middle-class Americans, protects unemployment insurance for 2 million Americans, and lays the groundwork for further work on both growth and deficit reduction," Obama said. "That's an achievable goal. That can get done in 10 days."

Maybe, maybe not. The latest plan faces uncertainty at best in the sharply divided Senate. GOP leader Mitch McConnell of Kentucky, who wields great power even in the minority, called Friday for Senate action on a House bill from the summer extending the full menu of Bush-era tax cuts. He promised that it will take GOP votes for anything to clear the Senate, where 60 votes are required to advance most legislation. Democrats control 53 votes.

Earlier, Boehner said Obama needs to give more ground to reach an agreement and that both he and Obama had indicated in a Monday telephone call that their latest offers represented their bottom lines. "How we get there," he added, "God only knows."

Congress shut down for Christmas and Obama flew to Hawaii with his family for the holidays. But both men indicated they'd be back in Washington, working to beat the fast-approaching Jan. 1 deadline with an agreement between Christmas and New Year's.

Obama announced his plans after talking by phone with Boehner and meeting with Senate Majority Leader Harry Reid, D-Nev., who had previously pinned his hopes on an Obama-Boehner agreement and is wary of dealing with McConnell.

At the White House, Obama projected optimism despite of weeks of failed negotiations. "Call me a hopeless optimist, but I actually still think we can get it done," he said.

Boehner spoke in the morning, describing the increasingly tangled attempts to beat the Jan. 1 deadline and head off the perilous combination of across-the-board tax hikes and deep spending cuts.

"Because of the political divide in the country, because of the divide here in Washington, trying to bridge these differences has been difficult," Boehner said. "If it were easy, I guarantee you this would have been done decades before."

Obama said that in his negotiations with Boehner, he had offered to meet Republicans halfway when it came to taxes and "more than halfway" toward their target for spending cuts.

It's clear, however, that there's great resistance in GOP ranks to forging a bargain with Obama along the lines of a possible agreement that almost seemed at hand just a few days ago: tax hikes at or just over $1 trillion over 10 years, matched by comparable cuts to federal health care programs, Social Security benefits and across federal agency operating budgets.

Obama said he remains committed to working toward a goal of longer-term deficit reduction to reduce chronic trillion-dollar deficits while keeping tax rates in place for nearly everyone.

"Even though Democrats and Republicans are arguing about whether those rates should go up for the wealthiest individuals, all of us ? every single one of us ? agrees that tax rates shouldn't go up for the other 98 percent of Americans," Obama said, citing statistics associated with his promise to protect household income under $250,000 from higher tax rates.

Neither the House nor the Senate is expected to meet again until after Christmas. Officials in both parties said there was still time to prevent the changes from kicking in with the new year.

The week began amid optimism that Obama and Boehner had finally begun to significantly narrow their differences. Both were offering a cut in taxes for most Americans, an increase for a relative few, and cuts of roughly $1 trillion in spending over a year. Also included was a provision to scale back future cost-of-living increases for Social Security recipients ? a concession by the president that inflamed many liberals..

GOP officials said some senior Republicans such as Rep. Paul Ryan, R-Wis., the most recent Republican vice presidential nominee, opposed the possible agreement. But No. 2 House Republican Eric Cantor of Virginia has joined arms with Boehner.

Boehner stepped back and announced what he called Plan B, legislation to let tax rates rise on incomes of $1 million or more while preventing increases for all other taxpayers.

Despite statements of confidence, he and his lieutenants decided late Thursday they were not going to be able to secure the votes needed to pass the measure in the face of opposition from conservatives unwilling to violate decades-old party orthodoxy never to raise tax rates.

The retreat came after it became clear that too many Republicans feared "the perception that somebody might accuse them of raising taxes," Boehner said.

Boehner also said that last Monday he had told Obama he had submitted his bottom-line proposal.

"The president told me that his numbers ? the $1.3 trillion in new revenues, $850 billion in spending cuts ? was his bottom line, that he couldn't go any further."

That contradicted remarks by White House press secretary Jay Carney, who said on Thursday that Obama has "never said either in private or in public that this was his final offer. He understands that to reach a deal it would require some further negotiation. There is not much further he could go."
