No room for error in Facebook's debut quarter

SAN FRANCISCO (Reuters) - Facebook Inc faces immense pressure to beat Wall Street's financial targets when its delivers its inaugural quarterly earnings report next week, hoping to wash away the bad taste left with investors from a soured IPO.

The No. 1 social networking company's second-quarter report on July 26 will be scrutinized by investors looking for clues on the health of its business, which is experiencing a sharp slowdown in revenue growth and mounting questions about its advertising sales.

With a rich multiple that gave Facebook the distinction of being the first U.S. company to go public with a valuation of more than $100 billion, the company headed by 28-year-old Mark Zuckerberg has little room for error.

"If they miss, it would be catastrophic for the stock," said Michael Binger, a portfolio manager with Gradient Investments.

"This is a very important earnings quarter for them. It will establish in people's minds how they think of the company," said Binger, whose firm does have a position in Facebook.

The bar has been lowered since Facebook warned that a shift in users to mobile devices - where its ability to earn revenue is still nascent - will hinder growth in the short run.

Analysts, on average, expect revenue in the second quarter to grow 28 percent to $1.15 billion. During the same period a year ago, Facebook more than doubled its revenue.

With Facebook's stock still trading at three-quarters its $38 IPO price, executives need to address a litany of concerns about the business, such as the efficacy of its online ads and the company's nascent efforts in mobile advertising.

Investors say Facebook is unlikely to be able to deliver the sort of numbers that can propel its stock back to debut levels, but the risk of triggering a slide if the company disappoints Wall Street is high. Facebook's stock still trades at a rich 57 times forward earnings, compared with Apple Inc's 13 times and Google Inc's 14 times.

"Facebook is probably going to come up with one or two revolutionary streams that are going to bump up its revenue," said Bill Lee, an angel investor who backed companies, including electric carmaker Tesla Motors Inc and social media site Posterous, which was recently acquired by Twitter. But "all the magic they can continue to deliver is already priced in."

SLOWING GROWTH

More than half of the 36 financial analysts now covering Facebook rate the company a Hold, Underperform or Sell - disproportionately high given that Wall Street analysts historically favor Buy ratings.

The three lead underwriters of the IPO - Morgan Stanley, Goldman Sachs and JPMorgan - forecast second-quarter earnings per share of between 10 cents and 11 cents, lower than the Street average of 12 cents, minus IPO-related stock compensation charges, according to Thomson Reuters I/B/E/S.

Thomson Reuters StarMine's SmartEstimates suggests that Facebook will post adjusted earnings of 10.4 cents per share.

"It gets back to 'How predictable are these companies' results going to be when I'm forecasting out pretty significant growth to be able to justify the valuation?'" said Ryan Jacob, chairman and chief investment officer of Jacob Funds, who does not own Facebook shares.

Facebook, which generated more than four-fifths of its revenue from advertising in 2011, has stepped up efforts to rebuild its revenue momentum, rolling out a raft of new advertising features and providing more details about the effectiveness of its ads.

TBG Digital, which helps marketers advertise on Facebook, released a study this week that found the average price of Facebook ads had jumped 58 percent since last year. That is partially due to recently released mobile formats, it found.

"Our clients aren't spending 75 percent of their budgets on Facebook," said David Jones, Global CEO of advertising agency Havas. But he noted that "there are very few clients who we are talking to who are negative on Facebook."

GUIDANCE QUESTION

With over 900 million users, Facebook is the world's largest social networking company, challenging established Web companies for consumers' online time and for advertising revenue.

For Facebook, the first date with Wall Street will mark an important test for the company's top brass to try to dispel some of the skepticism. Investors will want to hear from Zuckerberg - who wields majority control - but the company has not said if he will take questions on the day.

"A miss is a miss and it wouldn't be good either way, especially for your first quarter out of the gate," said Colin Sebastian, an analyst with Robert W. Baird.

But the context will be key.

"If it's related to shift in mobile, but the mobile monetization is improving, that's different than just a miss because advertisers are leaving Facebook."

And he said that many investors will be particularly interested in the trends the company is seeing as marketers take advantage of Facebook's mobile and other advertising features.

While most expect Facebook to follow the lead of Google and Amazon.com Inc and abstain from offering financial forecasts every quarter, it may address the current concerns about its business by providing additional color and outlook.

"This first time out, I think they have to give some sort of guidance," said Robert Bacarella, manager of the Monetta Fund, which does not own Facebook shares. "You pacify the near term and say 'Here's where we're going.' But then you set the table up to say: 'We're thinking about whether or not it's wise give guidance going forward."

For all Facebook's efforts to woo Wall Street, the company's biggest job remains building its relationship with advertisers, such as San Francisco's Public Bikes.

"Whenever we have a new bike shop selling our bikes in a particular city, I'll run a targeted Facebook campaign" in that city, said Dan Nguyen-Tan, Public Bikes' vice president of sales and marketing.

The ability to reach specific groups of Facebook users based on where they live and their interests - such as healthy lifestyles or environmental interests - is an important advantage of Facebook's advertising system, Nguyen-Tan said.

But he acknowledged that Public Bikes spends more money advertising with Google, where it is easier for the company to reach people interested in buying a bicycle.

Bipartisan powers, activate! Can Congress's debt avengers be superheroes?

Once again, Washington's bipartisan, blue-ribbon, out-of-power elite gathers to urge Congress to break the gridlock and do the right thing on the nation's looming financial Armageddon.

A bipartisan group calling itself the ?Fix the Debt Campaign? kicked off its work Tuesday, and when these?clear-eyed, pragmatic, bipartisan powers combine, they just might be the granddaddy of all Washington?s seemingly never-ending stream of commissions, working groups, and ?gangs? of all membership levels aimed at correcting the nation?s treacherous financial trajectory.

But that name just doesn?t have the right swing ? how about The Debt Avengers? The (Fiscal) Justice League? Or, if it wasn?t already sullied by congressional impotence, The Supercommittee?

Fix the Debt has arguably accumulated everybody who is anybody in Washington?s wonky, ?let?s get real? set about federal debt and deficits. The effort is led by former Sen. Alan Simpson (R) of Wyoming and Democrat Erskine Bowles. Yes, the Simpson and Bowles of the Simpson-Bowles plan to reduce the nation?s debt by $4 trillion over 10 years, which nearly every elected official in Washington says (when trying to sound reasonable and bipartisan) that they love in theory but won?t touch otherwise. A vote for a plan along the lines of Simpson-Bowles?in the House earlier this year turned up less than three dozen votes.

And that?s the group?s main question: What?s going to make it different from all the other herdings of well-meaning, rational, patriotic Americans who have beat their heads against the walls of Congress and the White House to no avail? Simpson-Bowles, after all, was the product of President Obama?s own debt commission ? a fact easily forgotten considering the president left the plan largely for dead upon its publication, only to broadly endorse it later on.

But Messrs. Simpson and Bowles have backup. They are joined by Alice Rivlin, the first-ever director of the Congressional Budget Office who, by her own admission, ?may have served on more debt commissions than anybody in Washington,? and is half of a duo (the other is former Sen. Pete Dominici (R) of New Mexico) that published a second bipartisan debt reduction plan.

Lawmakers looking for guidance from Wall Street types can look to famed investment banker Peter Peterson on the right or Steven Rattner, Mr. Obama?s auto czar, on the left. Those who want private-sector bona fides can find them in Honeywell chairman and CEO Dave Cote and World Fuel Services chairman and CEO Paul Stebbins. And for that down-the-middle, think tank-y wonkishness, there?s former World Bank chief Robert Zoellick and the president of the Committee for a Responsible Federal Budget, Maya McGuineas.

Lukaku scores 2 as?Chelsea beats Sounders

SEATTLE (AP) - There are still plenty of big names on Chelsea's roster keeping young Belgian striker Romelu Lukaku from getting significant playing time for the European champions.

Scoring a pair of goals in the Blues' first match since winning the Champions League crown was a pretty good statement that Lukaku is ready to contribute plenty more.

"I feel the pressure, but you play for Chelsea, there's pressure and we won, so that's the most important thing," Lukaku said. "The goals were good for me, but the most important thing is the team. I enjoyed it a lot."

Lukaku scored twice in the first half, newcomers Eden Hazard and Marko Marin scored deflected goals, and Chelsea opened its American tour with a 4-2 win over the Seattle Sounders on Wednesday night.

One of just two strikers currently part of Chelsea's tour roster, Lukaku muscled his way to a goal in the third minute of the international exhibition then scored his second goal in the final minute of the first half. It was the first match for Chelsea since the Blues beat Bayern Munich in May to win their first Champions League title.

"We were looking to (have) a good workout, good possession, some good combination play and slowly integrate new players and also see some of our younger talents that we have in the club that will hopefully be the future of the club," Chelsea manager Roberto Di Matteo said.

Seattle's Fredy Montero scored a pair of goals in the first half, but the Sounders missed a number of good scoring chances early and had few offensive opportunities in the second half.

Lukaku scored his first goal on a pass from Josh McEachran, one of the youngsters getting a chance to play for Di Matteo while some Chelsea regulars are either resting from the European Championships or going to the Olympics. Lukaku forced his way past defender Jeff Parke to score his first then added another in the 44th minute as Seattle's defense continued to leak.

Chelsea's two biggest offseason signings - thus far - also scored in the first half with Hazard, coming over from Lille, scoring in the 11th minute after his shot deflected off defender Jhon Kennedy Hurtado and past goalkeeper Bryan Meredith. Marin, who picked up a first-half assist, also scored in the 40th minute when his shot deflected off Parke.

Lukaku is stuck behind Fernando Torres and Daniel Sturridge in Chelsea's pecking order of strikers, but his large frame might make him a potential replacement for Didier Drogba in the future.

"I'm very keen to see him perform for us and then we'll see what happens," Di Matteo said. "But it's good to see he's a danger, he scores goals and that's what a striker has to do."

Unlike last year's 7-0 rout at the hands of Manchester United, the Sounders made this match respectable and at times controlled the offensive chances. Alvaro Fernandez and Eddie Johnson both had missed headers off corner kicks and Fernandez's open shot in the 24th minute was punched wide by Henrique Hilario.

Montero's first goal came off a poor giveaway by McEachran in the back end. Montero patiently waited and beat Hilario in the 14th minute, the first goal scored by Seattle in any of its previous exhibitions against European powers Chelsea, FC Barcelona and Man United. Montero made it a pair in the 32nd minute when Mauro Rosales' cross-field pass fell to Montero's feet and his left-footed shot beat Hilario again.

"We did good. We scored two goals against a tough team to play," Montero said. "Obviously we wanted to win the game but at the end of the day we need to be focusing on MLS."

Chelsea brought on regulars Frank Lampard, Michael Essien, Ramires and Gary Cahill after halftime and controlled more of the play but was unable to tack on additional goals.

The Blues were without five of their biggest names for the first stop of a four-game American tour that will feature the first soccer match at the new Yankee Stadium against Paris Saint-Germain, a match with the MLS All-Stars in Philadelphia and a final exhibition versus AC Milan in Miami.

Torres, who helped Spain win the European Championship earlier this month, and Portugal's Raul Meireles will join the tour later, along with captain John Terry. Flourent Malouda and Ashley Cole joined the team in Seattle with the other three expected to arrive on the East Coast.

Wednesday night was the final match for retiring Seattle midfielder Roger Levesque. The fan-favorite spent nine seasons with the USL-1 Sounders and the MLS Sounders and entered in the 66th minute to a standing ovation from the more than 53,000 in attendance.

Levesque was lauded on a walk around the field after the game and spent nearly 45 minutes signing autographs for fans.

"For me it was just insane. I was just happy to run around and try and get into the mix and make something happen," Levesque said.

TOOL Opiate (EP) music review by AtomicCrimsonRush

2 starsA beginning for Tool?

"Opiate" is the first Tool release and is a fair EP that got them into the music scene where they would eventually make an indelible impact. This is not prog metal as they would become but still rocks hard, and features wonderful riffing from Adam Jones and Maynard Keenan's inimitable vocal style. The tracks are far shorter and concise than they would release on subsequent albums, and sound more like alternative nu- metal than the complex musicians they would develop into. The songs are exuberant and exciting showing a band in their development stage, that were aggressive, darkly innovative, and wanted to conquer.

They would have to wait till "Aenima" to make a significant impact but this EP is rather endearing. 'Hush' and 'Part of Me' are heavy and have the signature Tool sound. The live tracks are intriguing showing an early immature Tool, and have some amusing introductions especially on 'Jerk-Off', one of the better tracks.

The longest track is the 8:28 minute 'Opiate/ The Gaping Lotus Experience', that musically is excellent but I feel offended by the lyrical content, especially the ghost track. Overall an EP showcasing the beginning of Tool, who would develop into one of the most inspirational bands over the next 8 years.

Astronaut trio docks with space station

(AP) ? A trio of astronauts traveling onboard a Russian-made Soyuz capsule has reached the International Space Station, two days after launching from the Baikonur cosmodrome in southern Kazakhstan.

NASA astronaut Suni Williams, veteran Russian cosmonaut Yuri Malenchenko and Aki Hoshide of Japan docked Tuesday slightly ahead of schedule at 08:51 a.m. Moscow time (0451 GMT). They will work at the orbiting laboratory until November.

They join current station residents ? Russians Gennady Padalka and Sergei Revin, and U. S. astronaut Joe Acaba.

The station, which orbits up to 410 kilometers (255 miles) above the Earth, is due to handle an unprecedented level of traffic.

Japan's HTV3 cargo ship will reach the station next week, the first of nine craft due to make contact with the orbiting satellite over a 17-day period.

The Magic 3-Step Formula for Attracting Anything

I?ve come across this formula in multiple courses, books and teachings on success, either spelled out or implied. ?It is the no-fail, tried and true secret to success that all masters use and most people get completely backwards. ?I have applied it to my own life and it always works. ?I?ve attracted work I love, friends I adore, an amazing life-partner and family of my own, and amazing places to live every time I?ve desired to move.

Ready for it? ?It?s BE-DO-HAVE.

Most of us focus on what we would like to HAVE, and go after it thinking that once we?ve attained or achieved it, we can do what we want to DO and then we will BE happy. ?The thing we want may be a nice house, a job, an amount of money, a marriage, children, our ideal body weight?and we are completely convinced that once we have attained this thing we will be fulfilled. ?We are so convinced of this, we would work in a job we don?t enjoy, hold off on dating someone we?re really psyched about, or spend years pursuing goals that are not our true passions.

When we do life according to: ?HAVE-DO-BE, it never works to generate true fulfillment and Wellness. ?Never.

I described some of this in an earlier post?HERE.

Why is it impossible? ?We can never experience happiness, peace or any kind of fullfilment as long as we put it in the future. ?Happiness can only exist Now, because life occurs in the present. ?Also, as long as we make our happiness contingent on something external, it is conditional, and it will always be linked to the fear of losing that thing. ?True happiness is generated within, is unconditional and cannot be taken away.

Think about it. ?Have you ever attained a long-worked for goal only to find the initial joy of attaining it wore off? ?Have you ever reached a milestone you were sure would bring fulfillment only to find it ultimately empty? ?Have you ever completed something, only to then find yourself pushing the bar further?

The joy and happiness that come from attaining a goal are limited and fleeting unless we are able to BE in Joy and happiness. ?Once we are being that (happy, fulfilled, worthy, successful) all the circumstances to support it come flooding into our life. ?They can?t not come into our experience.

What actually works in attracting our heart?s desire is: ?BE-DO-HAVE. ?Once we are able to BE happy (or healthy, or anything) the actions and behaviors we DO change and are easy to maintain, and this creates and attracts what it is we are wanting to HAVE.

So how to BE?.? ?There are several tools to assist with this and I teach many in my courses and coaching sessions. For instance, imagine what you desire (a slim fit body, money, success, freedom, partnership?) and see how you feel. ?How would you feel if you had it now?

Let?s say you want a slim fit healthy body. ?Are you able to clearly imagine BEing this? ?Are you able to muster up the feeling of lightness, alignment, vitality and health? ?If not, what thoughts come to mind? ?Are you thinking: ??I feel like crap.? ?OR ?I?m a big, fat slob.? ?OR ??No way could I have that????It?s not possible for me.???I don?t deserve to have this.? -or any other limiting beliefs? ?Maybe you?re not able to feel your body at all.

If you are able to feel good as you imagine having what you desire, you are close to creating it. ?Keep using visualization or a positive mantra and plug it into your every moment.

If you are unable to imagine this for yourself for any reason, you have beliefs to clear. ?Your limiting beliefs will become apparent when you move toward what you desire. ?Release the old beliefs. ?Program yourself with new beliefs that are aligned with what you would like, such as: ??I have a slim, fit and healthy body.?

This can be used for anything you are wanting to attract. ?Note: ?Be sure you focus on what you do want instead of what you don?t want. ?The body will respond positively to the above mantra, and negatively to: ??I am not fat.?

When your unconscious thoughts are programmed for failure, you can fight it by pushing yourself, working out like a fiend and eating next to nothing?and even if you do get results you will have to continue to work very hard to keep them. ?Until your thoughts are in alignment with health and fitness this will be an uphill battle. ?All the willpower in the world will not ?ultimately overcome this. ?However, once you change your thoughts, it will be effortless to do the behaviors that are consistent with them. ?You will be craving carrots and broccoli in no time!

The next step is: ?DO. ?What would you be doing if you were a success? ?How would you walk and talk? ?How would you move if you were loved beyond imagination? ?What would you look like if you were happy now. ?Research has shown that even the simple act of smiling induces a state of happiness by increasing hormones that initiate this state. ?So DO whatever it is you would do if you were already BEing what it is you are wanting to BE.

From this heightened state of existence you will attract life circumstances consistent with staying in that state: ?people will treat you differently, new opportunities will open up to you, and your physiology will respond positively. ?Think about it: ?if your body has the ability to slough off unneeded pounds, why wouldn?t it do that? ?It?s because of your programming.

It may take a little faith at first to see if this works. ?Maybe for years you?ve been told to work hard to HAVE security, and then you can relax and do what you really want to do. ?Maybe you believe that you will finally be happy once you attract a partner. ?Release your ideas about how life works. ?You are running a rat race. ?Security, peace, love or any other state we are desiring comes from within. ?Try it and look for evidence of your life responding.

Nexus 7 preorders start shipping in UK and Canada

The Nexus 7 machine is in full swing. According to Google, all pre-orders placed by Friday the 13th in the US and Australia have been filled as of today (though some may still be en route), and our friends in the UK and Canada should be receiving theirs soon enough. Deliveries are currently heading out in waves, putting 7-inches of Jelly Bean in the hands of eager "footie" fans and beneficiaries of socialized medicine. Brave Merida Gem Styling Doll & Brave Forest & Castle Playset ...





While we haven't seen the movie yet, we've seen tons of previews for the new Disney- Pixar movie, Brave.? My kids are, of course, very eager to see the movie and thrilled at the new toys they're seeing in the stores.? So when we had a chance to review the Brave Gem Styling Merida doll and Brave Castle & Forest Playset from Mattel, my daughter couldn't have been more thrilled!?



Being a girl, Brooke has seen her fair share of dolls in her young age, but she was still eager to have the newest one!? So far, however, she hasn't gotten a castle, and she was most excited about that toy in particular.? From the moment these came in the mail she was begging to get to play with them, and once the boxes were opened she did not put the toys down.? Day in and day out she has played with them, drug them around, even put them in her backpack to bring to church.



The Brave Gem Styling Merida doll comes with 6 gems to decorate Merida's blue gown or red hair.? Merida also has a reversible cape, one side blue and the other side a beautiful sparkly print.? A hair comb is also included, as well as Merida's bow and arrow.? Each of these accessories are removable.? This is great, as it allows Brooke to really play with every part of the doll and really use her imagination, but also makes it a bit rough to keep track of everything, especially the tiny gems.? We've been sure to be very careful to keep everything together at all times so nothing gets lost and, so far (knock on wood), everything is still accounted for!? Brooke has really enjoyed decorating Merida's dress and hair with the gems, and honestly, I found it entertaining as well! The gems have a velcro back, making them stick easily on Merida's dress or in her hair, but easy to remove and re-stick elsewhere.
The Brave Castle & Forest Playset is tons of fun too!? It came requiring a few pieces to be assembled, but it took me just a minute or two and it was ready! This set comes with quite a few pieces as well, including a bed, kitchen table and chair, treasure chest, Merida doll and her horse, Angus. The castle can be closed, revealing an outdoor forest.? When open it shows the inside of the kingdom where Merida lives.?
Brooke really enjoys playing with Merida and Angus, taking them all through the forest on an adventure before heading back to the castle for a nap. We have also been very careful to keep these pieces all together when she's done playing, but since the playset closes up, pieces can be put inside and kept together much easier.

Brooke is loving these new Brave toys, and couldn't be more thrilled with them! I love that they encourage her imagination and keep her busy playing with something instead of wanting to sit in front of the television during these hot summers!

Flood Insurance Program Wins Five-Year Extension | Anthony J ...

President Barack Obama signed a bill on July 6 that extends the National Flood Insurance Program for five years.

Hurricane Katrina in 2006 dealt a $16 billion blow to a federal program that was already operating at a deficit. The continuation of the program has been in doubt since then, and the Senate had passed only a 60-day extension in May.

?The uncertainty over the National Flood Insurance Program (NFIP) has come to an end as Congress passed a five-year extension of the federal flood insurance program on June 29, 2012 as part of a larger surface transportation authorization bill,? U.S. Rep. Frank LoBiondo (R-2nd) said in a news release.

LoBiondo voted with the majority as the bill passed in the House of Representatives, 373-52. The Senate voted, 74-19, to pass the bill the same day.

?The agreement on the NFIP extension comes after years of uncertainty about the federal program enabling property owners in participating communities to purchase insurance as a protection against flood losses in exchange for state and community floodplain management regulations that reduce future flood damages,? LoBiondo said.

LoBiondo?s office provided the following detail on the program:

?Almost one year ago, the House of Representatives overwhelmingly passed a five year reauthorization of the NFIP. However, the lack of action in the Senate on that measure resulted in numerous temporary extensions of the program and even one shutdown of the NFIP.? This uncertainty about the NFIP?s future has negatively affected the real estate market for homes in areas which are prone to flooding.

The NFIP extension passage will put those fears to rest and also will help reform the program to make it stronger for the future.? The bill includes provisions to reform the program, including requiring the government to explore ways that private sector can participate in the flood insurance market. Specifically, it would require the Federal Emergency Management Agency (FEMA) to assess whether the private market could bear the risks of offering flood insurance instead of taxpayers bearing the entire risk for flood insurance in the United States.

Participation in the NFIP is based on an agreement between communities and the Federal Government. If a community adopts and enforces a floodplain management ordinance to reduce future flood risk to new construction in floodplains, the federal government will make flood insurance available within the community as a financial protection against flood losses. This insurance is designed to provide an insurance alternative to disaster assistance to reduce the escalating costs of repairing damage to buildings and their contents caused by floods.

CFPB director Richard Cordray says supervising the credit reporting market ?will help ensure that it works properly for consumers, lenders, and the wider economy.?

NEW YORK (CNNMoney) ? Credit reporting agencies will soon be subject to federal oversight for the first time.

The Consumer Financial Protection Bureau announced Monday that it will begin supervising the nation?s biggest consumer reporting agencies this fall.

Consumer reporting agencies are private companies that collect financial data about millions of individuals ? often including past and present loans, debts and bankruptcies. Many financial institutions rely on reports from these agencies to determine the risk of applicants and to make lending and pricing decisions.

The ?vast majority? of the 113 million credit card accounts, auto loans, personal loans, mortgages and home equity lines originated last year were approved and priced based on data from these agencies, according to the CFPB.

There are about 400 credit reporting agencies in the country, and about 30 will be subject to the oversight ? those with more than $ 7 million in annual receipts.

Under the new rule that takes effect Sept. 30, the CFPB will be able to monitor business practices, conduct on-site examinations and write new rules.

?Supervising this market will help ensure that it works properly for consumers, lenders, and the wider economy,? CFPB director Richard Cordray said in a statement. ?There is much at stake in making sure it is both fair and effective.?

Cordray said that credit reporting agencies play a key role by helping financial institutions and other companies assess risk and prevent losses, but that some consumers may be unfairly blocked from credit they deserve. The consumer bureau has received complaints from many consumers who say their credit reports are inaccurate and that they are having trouble correcting them, he said.

The rule will apply to the three biggest credit bureaus ? TransUnion, Experian and Equifax (EFX). The three issue more than 3 billion reports a year and each hold records on more than 200 million people.

FICO (FICO), which provides the scoring algorithm most credit bureaus use to calculate credit scores, is not a credit bureau or lender, so it will not be subject to the new CFPB rule.

The CFPB is starting out with three main areas of focus: whether data given to reporting agencies by lenders and others is correct; whether the data is being processed accurately; and whether the dispute resolution process is effective.

In addition, specialty agencies that collect checking account data instead of credit histories will also be subject to federal supervision. This category includes companies like ChexSystems, a consumer reporting agency that holds records about more than 300 million consumers that 80% of the nation?s banks use to screen checking account applicants.

Previously, consumer reporting agencies had to comply with federal laws like the Fair Credit Reporting Act. But they were never subject to ongoing supervision ? meaning no government agency has been allowed to conduct regular reviews of their business practices.

The Dodd-Frank Wall Street reform law gave the new consumer bureau the authority to supervise nonbanks in the mortgage, payday and private education industries ? as well as nonbank ?larger participants.?

Next on the bureau?s agenda: debt collection. The CFPB said it plans to finalize a rule allowing it to supervise debt collectors this fall, and more ?larger participant? rules will follow.?To top of page

(AP) ? Joe Paterno's family on Monday strongly denied the findings of a special investigator who concluded the late football coach and other top Penn State administrators concealed Jerry Sandusky's sexual abuse of children in order to shield the school from bad publicity.

In a statement, the family said its lawyers will conduct their own investigation of the scandal.

"Our interest has been and remains the uncovering of the truth," the statement read.

The family characterized the 267-page report by former FBI Director Louis Freeh, who was hired by the university board of trustees, as "yet another shocking turn of events in this crisis" and said Paterno, who died in January at age 85, did not knowingly protect a pedophile.

"We are dismayed by, and vehemently disagree with, some of the conclusions and assertions and the process by which they were developed," the statement said. "Mr. Freeh presented his opinions and interpretations as if they were absolute facts."

Sandusky is awaiting sentencing after being convicted last month of 45 counts for abusing 10 boys.

Freeh, citing emails and handwritten notes, concluded that Paterno intervened to stop a plan by three top Penn State officials to report a 2001 allegation against Sandusky to child-welfare authorities.

The report also cited two emails that showed that Paterno knew about a 1998 allegation.

Freeh said Paterno and the other three officials, including ousted Penn State President Graham Spanier, exhibited "callous and shocking" disregard for child victims.

The Paterno family statement said the coach reported the 2001 allegation from graduate assistant Mike McQueary to his superiors.

"It can certainly be asserted that Joe Paterno could have done more. He acknowledged this himself last fall," the family statement said. "But to claim that he knowingly, intentionally protected a pedophile is false."

Monday's statement was issued amid calls for the removal of the famed statue of Paterno outside Beaver Stadium. A university spokesman said Sunday there's been no decision on the sculpture's fate.

A major fear for Wall Street has been that this whole scandal over rigging LIBOR (a common index of bank borrowing costs), would be seen by regulators and prosecutors as a chance for a "do-over".

And that seems to be happening.

Ben Protess and Mark Scott at the New York Times report:

The department?s criminal division is building cases against several financial institutions and their employees, including traders at Barclays, the British bank, according to government officials close to the case who spoke on the condition of anonymity because the investigation is continuing. The authorities expect to file charges against at least one bank later this year, one of the officials said.

It's not clear which banks, specifically, are in the target, but the general belief is that manipulation of the rate went far beyond Barclays (which just paid a massive fine, and saw both its chairman and CEO resign subsequently).

According to Protess and Scott, the CFTC is already preparing civil action against UBS.

There are few more bizarre or successful pairings in cinema than Spike Jonze and Charlie Kaufman. Now, the two aren't teaming up again (at least not just yet), but the writer of Adaptation and Being John Malkovich is teaming up with stop-motion studio Starburns Industries on a new project called Anomalisa. The animators, whose past credits include Moral Orel, don't want any interference from the traditional studio system and have turned to Kickstarter to fund the film. The roughly 40 minute feature will follow a motivational speaker whose life has become "hollow and meaningless." Sounds like a right, fun romp! There's little doubt that the movie will get made -- it's more than half way to its $200,000 goal and there's still more than 50 days left to the funding period. Kaufman is hardly the first big name in Holywood to turn to crowd-sourcing, but he's part of a growing trend of artists bucking the traditional system and sustaining themselves and their craft with direct support from fans. Carmen Commercial Real Estate - Office Vacancy Down. Prices Up? ?

As reported by commercial real estate industry publications during the past year as well as posts to this blog, the office vacancy rates in the greater Indianapolis area continue to drop as the net absorption of space has remained consistent, while essentially no new construction has been added to the market.

CoStar, the world?s leading commercial real estate data service bureau, reported today that the Indianapolis market vacancy rate has dropped to 9.9% during the second quarter of 2012, which is the lowest vacancy rate for this market in over five years, and lower than the national vacancy rate of 12.1%.? However, the change is not consistent for all Indianapolis submarkets across the board.? For example, Indianapolis? CBD has actually seen a recent increase in vacancy, as reported in the Indianapolis Star.? Yet, the City?s largest office market, north suburban Indianapolis, has experienced dramatic space absorption thus, accounting for a significant net decrease in market-wide vacancy.

Does this mean Tenants are going to pay more in rent when leasing office or industrial space, or when negotiating lease renewals?? In general?..yes.?? However, there are many variables that drive the economic and business terms of every commercial lease. ?There is an old saying in the commercial real estate industry, which is: ?every deal has a life of its own, meaning the lease terms negotiated by one business may vastly differ from the terms negotiated by another seemingly similar business.

We?ve seen this first hand at my firm, CARMEN Commercial Real Estate Services, where in the last year, in spite of declining vacancies, we have negotiated some of the best lease rates and landlord concessions for clients that we?ve seen in years.? But again, as a general rule, as vacancy continues to decline, landlords will become less aggressive in their attempt to lure and retain tenants with favorable lease rates and generous tenant improvement allowances.
